Workers’ Compensation
Rotator cuff injury is usually sustained at work because it generally requires repetitive motion. As a result, it is generally an injury suffered by warehouse and construction workers who use the same motion repeatedly in their line of work. Almost all employers are required to obtain workers’ compensation insurance which covers the cost of any injuries sustained at work. Workers’ compensation insurance allows companies not to have to pay the damages “out-of-pocket.” However, if the employer was negligent, they may be sued for additional expenses, more than what workers’ compensation covers. Disability Benefits

Vocational Rehabilitation Benefits
Sometimes an individual can go back to work after suffering an injury at work; however, that does not always mean the person can go back to their previous work level. Therefore, if someone can return to work but is still participating in vocational rehabilitation, they may receive up to $100 per week for a maximum of 13 weeks. In some situations, the number of weeks that vocational rehabilitation benefits are received may be extended.
Statute Of Limitations Concerning A Rotator Cuff Injury Case
Generally, a workers’ compensation claim must be filed within 90 days of sustained injury; this means that if the claim is not filed within 90 days, it will likely be dismissed. However, in some situations, the statute of limitations will be extended if the injured party does not know they were injured or who caused the injury. For example, if someone was injured and did not reasonably realize that it was work-related until six months after the injury was sustained, the plaintiff may have more than 90 days to file a claim.
